Terms of Use

These Terms of Use (“Terms”) apply to your access to and use of the websites, applications and other online services (collectively, our “Services”) provided by Time 2 Shine BMX LLC (“Time 2 Shine,” “we,” “us,” or “our”). By clicking to accept or by using our Services, you agree to be bound by these Terms (including the mandatory arbitration and class action waiver in Section 16). If you do not agree, you may not use our Services.

In addition, we may require you to accept Additional Terms that apply to particular features, promotions, products, or services (“Additional Terms”). If there is a conflict between these Terms and the Additional Terms, the Additional Terms will govern with respect to that feature.

Refer to our Privacy Policy for information about how we collect, use, and disclose information about you.

1. Eligibility

You must be at least 13 years old to use our Services. If you are under 18 (or the legal age of majority in your jurisdiction), you may use our Services only with the supervision and consent of a parent or legal guardian who agrees to be bound by these Terms.

2. User Accounts

Some features require you to register for an account. You represent that all information you submit is accurate and current, and you agree to maintain and protect your login credentials. You are responsible for all activity under your account, including by others you authorize to use it.

If we believe someone else has accessed your account without permission, notify us immediately at sales@time2shinebmx.com.

3. Terms of Sale

Availability and Pricing. All products are subject to availability, and we reserve the right to limit quantities, reject orders, or cancel orders (in whole or in part) without notice. Prices may change at any time.
Taxes. You are responsible for all applicable sales, use, customs, duty, or other governmental taxes (“Taxes”) related to your purchase. We may collect Taxes at checkout if required by law.
Payment. You agree to pay all charges for your order (including taxes and shipping) using valid payment methods accepted on our site. You authorize us to charge your chosen payment method.
Shipping & Risk of Loss. Shipping and handling fees are shown at checkout and may change over time. Unless stated otherwise, risk of loss passes to you when we hand the item off to the carrier.
Returns. Our Returns Policy describes how you may return items.
Errors. If there is an error (including incorrect pricing), we may cancel your order and refund any amounts you’ve paid. If the order has shipped, you may need to follow return instructions.
Product Warranties. Many products are made by third-party manufacturers. Unless explicitly stated, Time 2 Shine provides no additional warranty — items are sold “as is.” If the manufacturer offers a warranty, please see their documentation or website for details.

4. Limited License

We grant you a non-exclusive, non-transferable, revocable license to use our Services for personal, non-commercial purposes, subject to these Terms. You may not:

Copy, distribute, or display content (except for your personal use)
Modify, create derivative works, or remove rights notices
Use the Services for any commercial purpose
Reverse engineer, decompile, or attempt to extract source code

5. User Content

You retain ownership of content you post (like reviews, photos, comments). By posting content, you grant Time 2 Shine a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, distribute, publish, and display your content in connection with the Services and across media channels.

We may remove, edit, or refuse any content at our discretion. You warrant that you have rights to any content you post, and that posting it does not violate any law or third-party rights.

6. Prohibited Conduct

You agree not to use the Services to:

Harass, abuse, intimidate, or threaten others
Use another user’s account without permission
Disrupt or overload the Services or interfere with others’ use
Reverse engineer, hack, or bypass security measures
Scrape, mine, or collect data without permission
Use the Services for unlawful, fraudulent, or unauthorized activity

7. Prohibited Content

You may not post content that is unlawful, defamatory, obscene, infringing, misleading, or invasive of privacy. Content offering hacking, violence, or criminal instruction is forbidden. Content must not violate intellectual property rights or contain viruses or malicious code.

8. Hyperlinks

You may link to our Services for non-commercial purposes provided your site does not misrepresent us, display obscene or illegal material, or violate these Terms. You must remove any hyperlink upon request. Use of Time 2 Shine’s logos or trademarks for linking requires our written permission.

9. Third‑Party Content

Our Services may include content or links from third parties. We do not control or endorse third-party content, and are not responsible for it. Using third-party content is at your own risk, and any transactions or interactions are between you and the third party.

10. Feedback

If you submit feedback, suggestions, or ideas about our Services (“Feedback”), you grant us unlimited rights to use and exploit them without compensation or acknowledgment to you.

11. Copyright Complaints

We respect copyright laws. If you believe your work has been used without permission, contact our Legal Department:

12. Indemnification

You agree to indemnify, defend, and hold harmless Time 2 Shine BMX LLC and its officers, employees, agents, and affiliates from liabilities, claims, damages, costs, and expenses arising from:

Your use of the Services
Your content or feedback
Your violation of these Terms
Your infringement of third-party rights

You must promptly notify us of any claim and cooperate in defense of it.

13. Disclaimers

Our Services and products are provided “as is” without warranties of any kind. We do not guarantee the Services are error-free or uninterrupted. You assume all risks related to quality, performance, or defects.

14. Limitation of Liability

To the extent permitted by law, Time 2 Shine and related parties are not liable for indirect, incidental, special, or consequential damages arising from or related to these Terms or the Services, even if we were advised of the possibility.

For any claim related to a product, our maximum liability is limited to the greater of $100 or the purchase price of that product. Some jurisdictions may not allow certain limitations — if so, those limitations may not apply to you.

This limitation does not apply to personal injury, property damage, or liability that cannot be excluded by law.

15. Release

You release Time 2 Shine from claims, demands, or damages of any kind, known or unknown, arising from disputes between users or actions by third parties. You expressly waive any rights under laws similar to New Jersey Civil Code § 1542 or equivalent statutes.

16. Dispute Resolution; Binding Arbitration

PLEASE READ CAREFULLY — This Section requires arbitration for many disputes and limits how you can seek relief.

Except where Section 16(f) applies, you and Time 2 Shine waive your rights to a jury trial and agree to binding arbitration under JAMS’s Streamlined Arbitration Rules.
Disputes must be brought on an individual basis — no class actions or representative claims.
These Terms and arbitration obligations are governed by the Federal Arbitration Act (FAA).
Any arbitration for claims under $25,000 may be conducted by phone or in your county of residence.
Claims must be filed within one year after they arise or they are waived.
You may opt out of this arbitration requirement within 30 days of first accepting these Terms by emailing sales@time2shinebmx.com with your name and a clear statement that you opt out. If you opt out, Section 17 governs dispute resolution instead.
Section 16 does not apply to (i) small claims court disputes or (ii) disputes seeking injunctive relief for intellectual property infringement.

17. Governing Law & Venue

These Terms and your use of the Services are governed by the laws of South Carolina (without regard to conflict‑of‑law rules). Any disputes that are not subject to arbitration (or small claims) will be resolved in the state or federal courts in South Carolina.

18. Export Compliance

You agree to comply with U.S. export control, customs, and economic sanctions laws. You represent that:

You are not located in a restricted country
You are not on a U.S. government prohibited party list

19. Government Users

If you are acting on behalf of a U.S. government agency, you acknowledge that software or documentation constitutes “commercial computer software” and your rights are limited to those in these Terms.

20. Termination

We may, at our discretion, suspend or terminate your access or use of any part of the Services at any time, without notice. We are not liable for any loss or harm from such termination.

21. Miscellaneous

If any provision is found invalid or unenforceable, it will be severed without affecting the rest. These Terms (with any Additional Terms) constitute the full agreement between you and Time 2 Shine. Any failure to enforce a right does not waive that right. You may not assign your rights or obligations under these Terms, but we may transfer ours.

Communications and transactions may occur electronically.

22. Changes to Terms

We may modify these Terms from time to time. When we do, we will post updates and change the “Last Updated” date. Continued use after changes means acceptance. If you don’t agree to changes, stop using the Services.
